I UNDERSTAND I AM SIGNING UP TO BE A MEMBER OF ATU.COM. MEMBERSHIP INCLUDES THE OPTION OF THE ATU MAINTENANCE PROGRAM. UNDER THIS PROGRAM I, AS THE PROPERTY OWNER AND/OR CONTRACTOR, CAN PROVIDE CROTTY SERVICES INC MONTHLY AND SEMI-ANNUAL INSPECTIONS ON MY ATU SYSTEM. CROTTY SERVICES WILL PROVIDE THE MAINTENANCE AGREEMENT FOR MY SYSTEM AS REQUIRED BY CODE AND WILL MONITOR THE SYSTEM VIA MY SUBMISSIONS. AT NO TIME WILL CROTTY SERVICE BE RESPONSIBLE FOR THE ACCURACY OF MY SUBMISSIONS, NOR WILL CROTTY SERVICES BE RESPONSIBLE FOR THE CONDITION OR REPAIR OF MY SYSTEM. I FURTHER UNDERSTAND I AM RESPONSIBLE FOR THE ACCURACY OF MY SUBMISSIONS AND FOR THE PROPER OPERATION AND REPAIR OF MY SYSTEM AS PER CODE. I AGREE TO PROVIDE INSPECTIONS MONTHLY AND SEMIANNUALLY AS SPECIFIED BY CROTTY SERVICES AND ATU.COM. THE AGREEMENT WILL REMAIN IN EFFECT UNTIL I FAIL TO PROVIDE ANY REQUIRED INSPECTION WITHIN 30 DAYS OF ITS DUE DATE. THE DEPARTMENT WILL BE NOTIFIED OF THE CANCELATION, AND I WILL HAVE TO GET MY ATU CLEANED BEFORE I CAN RE-INSTATE THE AGREEMENT. IF MEMBERSHIP LAPSES, THERE WILL BE A REINSTATEMENT FEE THAT MUST BE PAID TO REMAIN IN GOOD STANDING.

This Service Agreement is entered into on December 19, 2025 by and between the Property Owner and/or Contractor, whose name and address are provided above, and CROTTY SERVICES INC (Service Provider). The Service Provider agrees to operate and maintain the Aerobic System located at the address provided by the Property Owner and/or Contractor. This agreement remains in effect until canceled by either party.

1. I, for Crotty Services Inc., shall perform 12 inspections a year; including inspection, adjustment and servicing of the mechanical, electrical and other applicable component parts to ensure proper function. This includes inspecting the control panel, air pumps, air filters, diffuser operation, and ordering services of a licensed professional to replace or repair any component not functioning correctly.


2. Semi-annually, such inspections shall include an effluent quality inspection consisting of a visual check of color, turbidity, scum overflow, and examination for odors.


3. If any improper operation is observed, which cannot be corrected at the time of the inspection, I will notify a licensed professional immediately and order repair or service to be completed as soon as possible.


4. I agree to maintain a factory-authorized service provider for the lifetime of the system, as required by state law applicable to aerobic systems. Crotty Services Inc. agrees to make available, for purchase, a continual service agreement for normal inspection, maintenance, and repair.


5. This service agreement does not cover the cost of service calls, labor, or materials required due to misuse or abuse of the system; failure to maintain electrical power to the system; sewage flows exceeding the hydraulic/organic design capabilities; disposal of non-biodegradable materials, chemicals, solvents, grease, oil, paint, etc., or any usage contrary to the requirements listed in the owner’s manual or advised by a Crotty Services Inc. service representative.


6. Additional services not scheduled per this agreement—such as pumping, after-hours visits, effluent sampling, excessive cleaning, and/or additional gallons removed—will be the responsibility of the Property Owner and/or Contractor.


7. Any additional visits, inspections, or sample collections required by specific Municipalities, Water/River Authorities, County Agencies, the State, or any other regulatory agencies in your jurisdiction will not be covered by this agreement.


8. Should this service agreement become terminated for any reason, the Property Owner and/or Contractor must contract with another approved maintenance entity and notify the DOH CHD within 60 days in writing from the date of termination. A copy of the new service agreement must be provided as well.


9. Should this agreement become terminated for any reason, Crotty Services Inc. will notify the Property Owner and/or Contractor and the DOH CHD in writing 60 days prior to the date of termination.


10. The Property Owner and/or Contractor has a right to maintain their own system. While they are exempt from contractor registration requirements for performing construction, maintenance, or repairs on the system, they are still subject to all permitting requirements.

By signing this Agreement, both Crotty Services Inc. and the Property Owner and/or Contractor agree to the terms contained herein.
